Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Kiu mobile application (the “App”) provided by Matjahu (“we”, “us”, or “our”). By downloading, accessing, or using Kiu, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Kiu. By using the App, you represent that you meet this requirement and that the information you provide is accurate.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date.
  • You may sign in using Email/Password, Google Sign-In, or Apple Sign-In. You are responsible for your use of these third-party sign-in providers under their respective terms.
  • Notify us immediately of any unauthorized use of your account.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use Kiu for your personal, non-commercial use, subject to these Terms. You may not:

  • Copy, modify, distribute, sell, or lease any part of the App.
  • Reverse engineer, decompile, or attempt to extract the source code, except where permitted by law.
  • Use the App in any unlawful manner or in a way that could damage, disable, or impair the service.
  • Attempt to gain unauthorized access to our systems, other users' accounts, or the backend infrastructure.

4. Subscriptions and Payments (Kiu Premium)

Kiu offers a free tier with usage limits and an optional paid subscription, Kiu Premium, which unlocks additional features (such as unlimited habits and stacks, and additional icons and colors).

  • Billing: Subscriptions are purchased and billed through the Apple App Store or Google Play, according to the plan you select. Payment is charged to your app store account.
  • Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Managing and canceling: You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: Refunds are handled by Apple or Google in accordance with their policies. We do not directly process payments or refunds.
  • Price changes: We may change subscription prices. Any changes will apply to future billing periods and, where required, be communicated to you in advance.

5. User Content

  • You retain ownership of the content you create in the App (habits, stacks, and related data) (“User Content”).
  • You grant us a limited license to store, process, and synchronize your User Content solely to provide the App's functionality.
  • You are solely responsible for your User Content and for backing up any important information. We are not liable for any loss of User Content.

6. Acceptable Use

You agree not to use Kiu to:

  • Violate any applicable law or regulation.
  • Infringe the rights of others.
  • Distribute malware or interfere with the App's operation or security.
  • Circumvent usage limits, subscription controls, or security features.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

The App, including its design, logos, trademarks, text, graphics, and software (excluding your User Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

8. Third-Party Services

Kiu integrates third-party services, including Google Firebase, Google Sign-In, Apple Sign-In, and RevenueCat. Your use of these services may be subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

9. Availability and Changes to the Service

  • We strive to keep the App available but do not guarantee uninterrupted or error-free operation.
  • We may modify, suspend, or discontinue the App or any of its features at any time, with or without notice.
  • We may update the App, and you may need to install updates to continue using it.

10. Disclaimer of Warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements or be secure, uninterrupted, or error-free. Kiu is a productivity tool and does not provide medical, psychological, or professional advice.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Termination

  • You may stop using the App and delete your account at any time.
  • We may suspend or terminate your access if you violate these Terms or for any lawful reason.
  • Upon termination, the licenses granted to you end. Provisions that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will remain in effect.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory consumer protection laws in your country of residence provide otherwise.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated “Last updated” date. Your continued use of Kiu after the changes take effect constitutes acceptance of the revised Terms.
